I've always wondered this; what ever happened to the TN IP? Where did it go after Looking Glass's Closure?
The trademark is dead. As for the actual game, it was both developed and published by LGS so it probably went to Star Insurance / Meadowbrook when they bought all their assets after liquidation. Whether that remains true today, I don't know.
